Terms and Conditions for Long Trail Media 

Effective Date: 01-01-25

Welcome to Long Trail Media. These Terms and Conditions govern your use of our services. By booking or engaging with us, you agree to the terms outlined below.

1. Services

We provide professional photography services, including but not limited to:

  • Event photography (e.g., weddings, corporate events).
  • Social Media(e.g., posts, reels, adds, or stories).
  • Commercial photography (e.g., product, real estate).

Specific details of the services will be outlined in the agreement or booking confirmation.

2. Bookings and Payments

a. Booking Confirmation

A booking is confirmed only after we receive a signed agreement and a deposit payment of 25% of the total fee.

b. Payment Terms

  • The remaining balance is due 5 days before the scheduled event.
  • Late payments may incur additional charges.

c. Cancellations and Refunds

  • Cancellations made 14 days before the scheduled date are eligible for a refund of the deposit, minus an administrative fee of 25 dollars.
  • Cancellations made within 3 days will forfeit the deposit.

3. Client Responsibilities

  • Provide accurate details about the event, location, and timing.
  • Obtain necessary permissions for photography at the venue.
  • Ensure a safe and respectful environment for our photographers.

Failure to meet these responsibilities may result in delays or termination of services.

4. Delivery of Photos

a. Editing and Retouching

We will deliver edited and retouched photos as per the agreed timeline, typically within 4-6 weeks after the event or shoot.

b. Delivery Format

Photos will be delivered digitally via  e.g., online gallery, USB, or drop box/ drive. Printed products, if included, will be delivered separately.

c. Archiving

We retain your photos for 6 months after delivery. Beyond this period, we may not guarantee availability.

5. Ownership and Usage Rights

a. Photographer’s Copyright

All photos remain the intellectual property of Long Trail Media.

  • We reserve the right to use photos for promotional purposes unless otherwise agreed in writing.

b. Client’s Usage Rights

  • You are granted a non-exclusive, personal license to use the photos for personal or business purposes.
  • You may not sell, edit, or alter the photos without our consent.

6. Liability

a. Limitation of Liability

  • We are not liable for circumstances beyond our control, including but not limited to weather, venue restrictions, or equipment failure.
  • In the unlikely event of total service failure, our liability is limited to a  50% refund of the fees paid.

b. Client’s Liability

  • The client is responsible for any damage caused to our equipment by themselves or their guests.

7. Force Majeure

We are not responsible for delays or cancellations caused by events beyond our control, such as natural disasters, strikes, or government restrictions. In such cases, we will work with you to reschedule the service.

8. Confidentiality and Privacy

We respect your privacy and will handle your data in accordance with our Privacy Policy.

9. Governing Law

These Terms and Conditions are governed by the laws of colorado

10. Amendments

We reserve the right to update these Terms and Conditions at any time. Changes will be communicated via email or posted on our website.

At Long Trail Media , we strive to deliver exceptional quality and service. However, due to the nature of our media services and products, specific refund and return policies apply. By engaging with us, you agree to the terms outlined below.

1. Refund Policy

a. Non-Refundable Deposits

All deposits paid at the time of booking or project initiation are non-refundable. These deposits secure your booking and compensate for the time and resources allocated to your project.

b. Service-Based Refunds

Refunds for services (e.g., video production, photography, graphic design) are not available once the work has commenced. If a project is canceled before work begins, a partial refund may be issued at our discretion, minus the non-refundable deposit and any preparatory costs incurred.

c. Product-Based Refunds

For physical or digital media products (e.g., DVDs, USB drives, digital downloads):

  • Refunds are not available for delivered products.
  • In the case of defective products, we will provide a replacement after verifying the defect.

2. Return Policy

a. Physical Products

Returns are accepted only for defective physical products (e.g., damaged prints, corrupted USB drives).

  • You must notify us within 7 days of receiving the product.
  • Upon verification of the defect, we will issue a replacement.

b. Digital Products

Digital media files are non-returnable and non-refundable once delivered, as they cannot be "returned" in a traditional sense. If you encounter issues accessing or downloading your files, please contact us for assistance.

3. Project Cancellation

a. Client-Initiated Cancellation

If you choose to cancel a project:

  • Cancellation before the agreed start date may result in a partial refund, minus the non-refundable deposit and any preparatory costs.
  • No refunds will be issued for cancellations made after the project has commenced.

b. Company-Initiated Cancellation

If we must cancel your project due to unforeseen circumstances:

  • We will offer to reschedule or refund the amount paid, including the deposit.
  • Refunds will not apply if the cancellation is due to a breach of these terms by the client.

4. Amendments and Revisions

a. Client Revisions

  • Revisions are subject to the terms of your service agreement made at time of consultation 
  • Additional revisions or changes beyond the agreed scope will incur extra charges.

b. No Refund for Revisions

Refunds will not be provided for dissatisfaction with revisions. We will work with you to resolve concerns within the agreed project scope.

5. Force Majeure

Refunds are not available for delays or cancellations caused by events beyond our control, such as natural disasters, government restrictions, or technical failures. In such cases, we will work with you to reschedule or find an alternative solution.
